The Supreme Court is established by Article III, Section 1 of the Constitution of the United States, which says: "The judicial Power of the United States, shall be vested in one supreme Court .

The size of the Court is not specified; the Constitution leaves it to Congress to set the number of justices.

When the cases in volume 265 were decided the Court comprised the following nine members: In Hester v. United States, 265 U.S. 57 (1924), the Supreme Court established the open-fields doctrine.

The Court held that "the special protection accorded by the Fourth Amendment to the people in their 'persons, houses, papers and effects', is not extended to the open fields."

This rule of criminal procedure, is the legal doctrine that a "warrantless search of the area outside a property owner's curtilage" does not violate the Fourth Amendment.
