On January 16, 2010, Killpack resigned from the Utah Senate after being arrested on suspicion of drunk driving.
[3] After fighting the charge for nearly a year, he pleaded guilty to Class B Misdemeanor driving under the influence.
[3] Killpack was sentenced to 180 days in jail, the sentence was suspended, and he was required to perform 48 hours of community service, pay $1,350 in fines, take a class for DUI offenders and attend a victim-impact panel.
