[2] From 1999 to 2000, Schulte served as a law clerk to the South Dakota Second Judicial Circuit in Sioux Falls.

[2] In December 2023, Schulte was seen as a top contender for nomination to the federal bench.

President Biden nominated Schulte to the seat being vacated by Judge Karen Schreier, who announced her intent to assume senior status upon confirmation of a successor.

[7] The Republicans on the committee opposed his nomination because of Schulte's prior writings on the issue of “preclearance”.
