Gilmer was born in Guilford County, North Carolina near Greensboro.

He then studied law and was admitted to the bar in 1832 and began practice in Greensboro.

In 1856, Gilmer was the Whig candidate for Governor of North Carolina but was defeated.

In January 1861, Abraham Lincoln considered him for a position in his incoming cabinet, and William H. Seward sounded him out on the question, but Gilmer temporized until the matter was dropped.
